SPECIAL CONDITIONS OF SALE FOR TOURIST PACKAGES AND SERVICES of the Montluçon, du Cher à Tronçais Intercommunal Tourist Office on 8 December 2025 In accordance with article R211.4 of the Tourism Code, these special terms and conditions of sale are intended to inform the customers of the Montluçon, du Cher à Tronçais Intercommunal Tourist Office, known as Montluçon Tourisme, prior to signing the contract. In accordance with article L211.9 of the Tourism Code, this pre-contractual information will form an integral part of the contract and may only be modified within the framework of an agreement expressly agreed between the parties. These CPV may be modified and updated by Montluçon Tourisme at any time. The applicable CPV are those in force at the time of the order. The present CPV are communicated to the customer at the time of booking a service with Montluçon Tourisme and can be consulted and downloaded from the website: www.montlucon-tourisme.fr1. Formation of the contract1.1 – General provisions The reservation of one of the tourist services (accommodation, transport, stays, guided tours, ticketing, etc.) is subject to the following conditions) offered by Montluçon Tourisme implies unreserved acceptance of the provisions of our special conditions of sale (CPV). 1.2 – Formation of the contract Apart from the website, all reservation requests must be communicated in writing to Montluçon Tourisme either on site, or by email to contact@montlucon-tourisme.fr, or by post to Montluçon Tourisme – 67 ter Boulevard de Courtais – 03100 Montluçon. All orders will not be considered definitive until : – receipt of the completed, dated and signed contract or proposal, subject to confirmation by Montluçon Tourisme, taking into account technical feasibility, available places and, if applicable, a minimum number of participants. The elements of the contract or proposal relating to the particular requests of the customer take precedence over those appearing on the present CPV without prejudice to the texts in force. – and secondly, receipt of a deposit of 25% of the total cost of the services or the balance for all bookings made less than 10 days before the start of the service. 2. Conditions for the provision of services For all services sold by Montluçon Tourisme, given their time-limited nature, they may under no circumstances be extended after the date on which the service is due to begin. The customer must arrive on the day and at the time specified on the booking contract with the voucher. In exceptional circumstances, we may be forced to cancel a tour if the minimum number of participants is not reached. You will be informed of this decision in accordance with article 6.2 of these CPV. In the event of cancellation by Montluçon Tourisme, your payments will be returned to you in full, without any further compensation. All costs incurred by the customer remain at their expense. 2-1 For stays with accommodation The accommodation services included or not in a package are calculated in number of nights. Prices include room hire and, where applicable, depending on the terms of the contract, breakfast, half board or full board. The services included in the package are specified on the product sheet on our website or in our various brochures for each service. Unless otherwise specified in the contract, they do not include mealtime drinks or any other supplements. If a customer occupies a room designed for two people, a supplement known as the “single room supplement” will be charged. When booking accommodation, we strongly advise you to inform the accommodation provider directly of your arrival time, as some establishments do not have night reception facilities. 2-2 For coach journeys Passengers must comply with the driver’s instructions and directives and respect the rules imposed, in particular: fasten seat belts, do not smoke or fart, do not block the way, distract the driver, ask permission to speak to the driver. Passengers must also adhere to the timetable on departure and after each break. 2-3 For the booking of guided tours For all guided tours, the tour may be cancelled by Montluçon Tourisme in view of bad weather conditions or in the cases of force majeure referred to in article 6.3 of the present CPV – in this case the amount paid will be refunded without any claim for compensation. Each participant must comply with the rules of safety, caution, handling of tools, routing and traffic and follow the instructions and advice of the guide and/or service provider throughout the visit. Children are the sole responsibility of their parents, guardians, teachers or carers. As the tours take place on foot, participants must be equipped with good footwear and clothing suited to the weather conditions of the day. Customers must ensure that they are physically and mentally fit to take part in the tours, some of which have difficulties or special features (stairs, distances, heights, slippery floors, etc.). If you have any doubts about your ability, we recommend that you contact Montluçon Tourisme beforehand to obtain more information about the services in relation to your ability. The customer must arrive on the day specified at the time and place mentioned on the contract. Unless otherwise specified, the minimum group size for guided tours is 10 people and the maximum is 50 people. Above this threshold, the presence of a 2nd guide is compulsory. 2-4 For activities involving the consumption of food and drink For services involving, in particular, food products, customers who are allergic or intolerant to certain foodstuffs must notify Montluçon Tourisme and/or the service provider before consumption. For services including alcoholic beverages, it is reminded that “Alcohol abuse is dangerous for your health” and that Montluçon Tourisme and/or the service provider concerned may limit or prohibit the consumption of alcohol depending on the situation. 3. Withdrawal The 14-day right of withdrawal does not apply to tourist packages and other tourist travel and leisure services not included in the package (tickets, guided tours, etc.) which are supplied on a specific date or during a specific period in application of article L221-28 of the French Consumer Code. 4. Prices All prices are quoted in euros and include VAT. Unless otherwise stipulated in a description of a service confirmed in the contract, the following are not included in the price: personal expenses, insurance, optional services not included in the description of the service and, where applicable, tourist tax. 5. Payment All bookings are subject to the payment of a deposit no later than 30 days before the start of the service and a balance no later than 10 days before the start of the service, depending on the type of service booked, as indicated on our media and on the contract. For services for which a deposit and balance are paid less than 10 days before the start of the service, the full price of the service must be paid at the time of booking. Payment must be made: In cash: in euros only, at the offices of Montluçon Tourisme within the limits stipulated by articles L112-6 and D112-3 of the French Monetary and Financial Code, By bank or postal cheque : made payable to Montluçon Tourisme, and where applicable, proof of identity must be provided by presenting an identity card or passport. By bank transfer + IBAN (see invoice and/or contract), By credit card: at the offices of Montluçon Tourisme. Montluçon Tourisme will send an invoice to the customer after full confirmation of registration. Once the booking has been confirmed, Montluçon Tourisme will send the customer the various vouchers to be handed in when visiting each service provider. 6. Cancellation conditions6.1 By the customer: groups, individuals and groups made up of individuals In accordance with article L. 211-14, I of the Tourism Code, the customer may cancel the contract at any time before the start of the service, provided that the following procedure and conditions for reimbursement are respected: – Any partial or total cancellation must be notified by e-mail to contact@montlucon-tourisme.fr or by registered letter with acknowledgement of receipt to: Montluçon Tourisme – 67 ter Boulevard de Courtais – 03100 Montluçon. – Cancellation of individual tourist services and packages, the cancellation/rescission fees are as follows, unless otherwise specified in the contract: – 30 days before the start of the holiday, the customer will receive a full refund of the sums paid, – between the 30th and the 21st day inclusive before the start of the holiday : 25% of the price of the service will be retained, – between the 20th and 8th day inclusive before the start of the holiday: 50% of the price of the service will be retained, – between the 7th and 2nd day inclusive before the start of the holiday: 75% of the price of the service will be retained, – less than 2 days before the start of the holiday: 100% of the price of the service will be retained. If the customer does not turn up or is late (see “Delay”), no refund will be made (see “Insurance”). If the customer interrupts the holiday, no refund will be made. A partial cancellation corresponds to a reduction in one of the elements of the service. The pro rata rule will be applied on the basis of the compensation arrangements set out above. These provisions do not apply when an amicable agreement is reached between Montluçon Tourisme and the customer. 6.2 On the part of Montluçon Tourisme In accordance with article L. 211-14, III of the Tourism Code, Montluçon Tourisme may cancel the contract and reimburse the customer in full for payments made, without there being any need for additional compensation, if : 1. The number of people registered for the tourist service or package is less than the minimum number indicated in the contract and Montluçon Tourisme notifies the customer of the cancellation of the contract within the time limit set out in the contract, and at the latest : – 20 days before the start of the service if its duration exceeds 6 days, – 7 days before the start of the service if 48 hours before the start of the service if it lasts less than 2 days. 2. Other cases of cancellation by Montluçon Tourisme When Montluçon Tourisme cancels the service before the start of the event, the customer, without prejudice to any claims for damages, will be reimbursed immediately and without penalty of the sum paid. The customer will also receive compensation at least equal to the penalty that would have been paid if the cancellation had been made by the customer on that date. These provisions do not apply when an amicable agreement has been reached for the customer to accept a substitute service proposed by Montluçon Tourisme. 6.3 Cases of force majeure The customer and Montluçon Tourisme have the right to cancel the contract before the start of the service without paying any cancellation fees when a cancellation or modification is imposed by a case of force majeure, such as – by way of example but not limited to the occurrence of a natural disaster, an armed conflicta labour dispute, an imperative injunction from the public authorities, a transport disruption, an operating accident – i.e. the occurrence of a natural disaster, an armed conflict, a labour dispute, an imperative injunction from the public authorities, a transport disruption, an operating accident – i.e. the occurrence of a natural disaster-In other words, the occurrence of an unforeseeable event, beyond the control of the parties, which cannot be overcome despite their best efforts to do so. The party invoking force majeure linked to an event mentioned above must notify the other party by all means in a clear, comprehensible and apparent manner on a durable medium as soon as possible. The parties may consult each other, as far as possible before the service is rendered, to consider in good faith whether the contract should continue or be terminated. The party adversely affected by the non-performance of the obligation prevented by the event in question shall have the right to cancel the service without notice. In application of article 1218 of the French Civil Code, there will be no entitlement to damages or interest. 6.4 Refunds for cancellation Except in the case of an agreement between Montluçon Tourisme and the customer on a postponement of the service, in the case of cancellation and in accordance with the terms of article R221-10 of the Tourism Code Montluçon Tourisme will make the refunds required by virtue of II and III of article L. 211-14 or, under I of article L. 211-14, reimburse all payments made by or on behalf of the traveller less the appropriate costs of resolution. These refunds to the traveller are made as soon as possible and in any event no later than fourteen days after the cancellation of the contract. 7.7.1 Modification by the customer Any request for modification before the start of the service must be sent by e-mail to contact@montlucon-tourisme.fr Any modification must be subject to the prior agreement of Montluçon Tourisme. As each request is treated on a personalised basis, Montluçon Tourisme is at the customer’s disposal to study any contractual modifications or requests for additional services. 7.2 Modification by Montluçon Tourisme In accordance with article L211-13 of the Tourism Code, Montluçon Tourisme may, before the start of the service, unilaterally modify the clauses of the contract other than the price in accordance with article L211-12 of the Tourism Code. The unilateral modification of Montluçon Tourisme will be possible without opposition from the customer if it is minor, foreseen in the contract (weather conditions, number of participants, availability of the service provider according to his craft or agricultural activity…) AND that the customer is informed as soon as possible in a clear and written manner. In the case of major changes, or changes that result in a price increase of 8%, the customer will be informed as soon as possible, in a clear and written manner, of the consequences of the change on the price of the day.In the absence of a reply within this period, the customer will be informed of the possible replacement service and its possible price. If the changes to the contract or the substitute service result in a reduction in the quality of the trip or holiday or in its cost, the customer is entitled to an appropriate price reduction. If the contract is cancelled and the customer does not accept another service, Montluçon Tourisme will reimburse all payments made by the customer as soon as possible and in any case no later than fourteen days after the cancellation of the contract, without prejudice to compensation in application of article L 211-17 of the French Tourism Code. 8. When a service specifies a precise time and place for the start of the service, in the event of the customer being late, the latter must notify Montluçon Tourisme as soon as possible.Montluçon Tourisme as soon as possible by telephone on 04 70 05 66 80 from 9am to 12pm and from 2pm to 5pm. Any services not used due to this delay will remain due and will not be reimbursed. 9. Transfer of the contract In accordance with articles L211-11 and R211-7 of the Tourism Code, the customer may, as long as the contract has not produced any effect, at the latest 7 days before the start of the service and by any means enabling an acknowledgement of receipt to be obtained, inform Montluçon Tourisme of the cancellation. of receipt, inform Montluçon Tourisme of the transfer of the contract to another person who satisfies all the conditions applicable to this contract and who fulfils the same conditions as the initial customer to carry out the service. In the event of transfer, the customer and the transferee will be jointly and severally liable for payment of the balance of the price as well as any expenses, fees or other additional costs incurred by this transfer. Montluçon Tourisme will inform the customer of the actual costs of the transfer, which must not be unreasonable nor exceed the cost actually borne by Montluçon Tourisme as a result of the transfer of the contract. 10. Responsibilities Montluçon Tourisme is the sole interlocutor of the customer and is responsible to him for the execution of the services ordered and the obligations arising from these special conditions of sale. It is fully responsible for the execution of the services provided for in the contract, whether these services are executed by itself or by other service providers, and is obliged to provide assistance to the customer in difficulty in accordance with the terms of article R221-10 (useful information on health services, local authorities and consular assistance, to make long distance communications and to find other travel services). Montluçon Tourisme cannot be held responsible for booking errors which are attributable to the customer or which are caused by exceptional and unavoidable circumstances, for the total or partial non-performance of the services ordered in a case of force majeure as defined in article 6.3 of the present CPV, the act of a third party, poor execution of its obligations by the customer, or in the event of fault on the part of the latter. The customer will inform Montluçon Tourisme, as soon as possible given the circumstances of the case, of any non-conformity noted during the execution of a travel service included in the contract. Montluçon Tourisme cannot be held responsible for damages of any nature that may result from the temporary unavailability of the site or an interruption in the customer’s connection during the registration, reservation or payment process. If one of the travel services is not carried out in accordance with the contract, Montluçon Tourisme will remedy the non-conformity.unless this is impossible or involves disproportionate costs, taking into account the importance of the non-conformity and the value of the travel services concerned. If Montluçon Tourisme does not remedy the non-conformity within the reasonable period set by the customer, the customer may remedy the non-conformity himself and claim reimbursement of the necessary expenses. 11. Insurance At the time of your reservation, Montluçon Tourisme does not suggest that you take out comprehensive or cancellation insurance and invites you to check that you also benefit from these guarantees with the insurer of your choice.It is your responsibility to contact them directly in the event of a claim, in order to initiate the appropriate procedure. 12. Protection of personal data Montluçon Tourisme is likely to collect personal data necessary for the computer processing of your registration, for its follow-up, the sending of newsletters, promotions and solicitations or within the framework of quality surveys (via electronic mail, SMS messages, telephone calls and postal mail). In accordance with the RGPD, you have the right to access, rectify, update, portability and delete your personal data at any time.You may exercise this right by contacting the person responsible for processing the data by sending an e-mail to contact@montlucon-tourisme.fr, or by post to Montluçon Tourisme – 67 ter Boulevard de Courtais – 03100 Montluçon, and in both cases by providing proof of your identity. Unless you notify us to the contrary by limiting or objecting to the processing of your personal data, we reserve the right to use this information to send you the various documents mentioned above. You also have the right to lodge a complaint with the CNIL. 13. Intellectual property / photos / illustrations The photos, maps and illustrations contained in the brochures and/or the website are illustrative and are not contractual in nature. Any reproduction or commercial or non-commercial use of these elements is strictly prohibited without prior written authorisation. The repeated and systematic extraction of protected or non-protected elements from the www.montlucon-tourisme.fr website causing any prejudice whatsoever to Montluçon Tourisme or to one of its service providers or suppliers is also prohibited. 14. Archiving of the contract Any contract concluded with the customer corresponding to an order of an amount greater than 120 euros (all taxes included) will be archived by Montluçon Tourisme for a period of 10 years in accordance with articles L213-1, R213-1 and R213-2 of the Consumer Code. Montluçon Tourisme will archive this information and will produce a copy of the contract at the customer’s request. 15. Complaints / Disputes The present CPV are subject to French law. Any complaint relating to a service must be sent to Montluçon Tourisme by email: contact@montlucon-tourisme.fr OR by registered letter with acknowledgement of receipt within 7 days of the end of the service provided. After contacting our Sales Department and if the Sales Department does not respond satisfactorily within 60 days, or if the response received is not satisfactory, the customer may appeal to the Tourism and Travel Ombudsman (www.mtv.travel). If the sale is made online, the customer may use the platform available on the https://webgate.ec.europa.eu/odr website to settle their dispute. Any dispute that cannot be settled amicably will be dealt with exclusively by the Montluçon Court of Justice in the case of a legal entity.In the case of an individual, jurisdiction is given to the competent court in accordance with article L141-5 of the French Consumer Code.
